Terms of Service

1. Acceptance of Terms

By accessing or using OpenClaw ("Service"), operated by Nascence Consulting LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

OpenClaw provides hosted AI assistant instances powered by open-source language models via the Ollama runtime. Each subscriber receives a dedicated instance accessible via a unique HTTPS subdomain with token-based authentication.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Subscriptions & Billing

Paid plans are billed monthly via Stripe. Your subscription renews automatically unless canceled before the current billing period ends. Cancellation takes effect at the end of the current period; no partial refunds are issued. We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to other users' instances
• Interfere with or disrupt the Service infrastructure
• Use the Service to generate harmful, abusive, or deceptive content
• Resell or redistribute access without written permission
• Exceed the resource limits of your subscription tier

6. Data & Storage

Workspace data is stored on our infrastructure for the duration of your subscription. Upon cancellation, your instance and associated data will be deleted within 30 days. You are responsible for exporting any data you wish to keep before cancellation.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We are not liable for any downtime, data loss, or damages arising from your use of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Nascence Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time through the billing dashboard or by contacting support.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
